1.Buyers terms and general conditions

1.1.    The general conditions apply to www.gatorzoutlet.com customers, (herein referred as the Buyer), and www.gatorzoutlet.com owner, Gatorz Europe OÜ (herein referred as Seller), by legal relationship created by purchase of goods. (registration number: 11160790, VAT: EE101009816, Located at Paneeli 2B, Tallinn, Harju 11415, Estonia. E-mail: info@gatorzoutlet.com). Buyer's order shall be deemed a quotation Obligations Act (LOA) sense. 

1.2.    Gatorz Eyewear web-shop operates as an online store with no physical store to visit. Web store is open for business 24 hours a day.

1.3.    Seller’s operating currency is EUR.

1.4.    All prices include VAT (20%).

1.5.    All conditions apply to all persons making purchases (orders) from the internet-shop.

1.6.  In additional to these conditions the purchase from Seller’s internet-shop is regulated be the legislation valid in the Republic of Estonia.

1.7.    Seller keeps the right to change the prices of products solely. The prices will take effect immediately as they are displayed on the web page. If the buyer has placed an order before the price change, the price which was effective on the moment that the order was placed, will be valid. The price will be invalid in case law conditions say otherwise.

1.7.1. If the Seller has made a mistake on the webpage concerning the information regarding products, the buyer should notify of them via info@gatorzeyewear.com and not take advantage of the situation. In case the price or quantity of the product has been input incorrectly, Seller may notify the buyer and refuse from finalizing the ordering process. Already made payments will be refunded.

1.8.    The product information, price and description has been added to every item.

1.9. Before making an order, the buyer will have to agree to the terms and conditions and takes responsibility to respect the terms to their means.

1.10. Buyers who do not agree to the set terms may not make an order.

1.11. To make an order, the buyer will have to add an item (or items) to the shopping cart.

1.12. Click on the picture and add the product to cart. Fill out the order form (Personal data), choose payment system. After a few minutes you will get confirmation on your e-mail address. When you order goods from our internet-shop, the system books/reserves the item automatically and we start to prepare for the shipping at the earliest opportunity. You can also change the number of products, quantity in your cart before payment will be done. Confirm the changes made by clicking on the "calculation" button.

1.13.Ordering from our system books the items automatically and we will start preparing it as soon as possible.

1.14 The products are sold as is. The Seller has no responsibility to accept returns. 

2.       Payment and delivery terms

2.1.    If You are a resident in a Military base, please provide an address that is not Post Office Box or Military Army Post Office/Fleet Post Office/British Forces Post Office address.

2.2.    After confirming an order the buyer will receive an invoice on the provided e-mail address.

2.3.  When making the payment, it is very important that the invoice number is written in the comment section.

2.5.    PayPal stores and safeguards your card and bank details, enabling you to pay online without entering your sensitive financial information every time you shop. You speed through checkout in just a few clicks, PayPal takes the payment from your card or PayPal- balance directly, and your payment details are never shared with the merchants.

2.6.    GATORZ EUROPE OÜ accepts the following credit and debit cards: Visa, MasterCard & American Express. Payment is debited from your card at time of dispatch. All transaction on www.gatorzoutlet.com are processed using Nets Estonia, a third party secure online payment gateway that encrypts your card details in a secure host environment. All customers paying by card are subject to validation checks. For security reasons, we do not store any payment information in our database.

2.7.     Invoices should be paid within 7 days. After 7 days the order will be canceled.

2.8.    After a successful payment the items will be shipped out within 12 days.

2.9.  If by any chance there are not enough items in stock by the time of order, the Seller will notify the buyer immediately and provides a possibility to order more.

2.10.  Shipping rates:

2.10.1.    Local Post (Eesti Post) inside EU (1 pair of sunglasses-10€, if more then 10€*(1+(quantity*0,25)) (Shipping and handling) 

2.10.2.    Local Post (Eesti Post) outside EU (1 pair of sunglasses-15€, if more then 15€*(1+(quantity*0,25)) (Shipping and handling) 

2.10.3.    Courier service inside EU (1pair of sunglasses-25€, if more then 25€*(1+(quantity*0,5)) (Shipping and handling) 

2.10.4.    Courier service outside EU (1 pair of sunglasses-40€, if more than 40€*(1+(quantity*0,5)) (Shipping and handling)

2.11.Delivery fees shall be paid by buyer.

2.12.Seller takes responsibility in successful delivery via providing a tracking number.

2.13.The buyer will receive a confirmation e-mail once the items have been dispatched.

3.       Quality and rights

3.1.    Seller is responsible for the information and quality of the items on the webpage.

3.2.    For technical reasons colors in print/screen may slightly differ from actual color.

3.3.    Seller is not responsible for the damages and faults dealt by the buyer. Neither for misuse of the products.

3.4.    Buyer is obligated to report a fault within 14 days after finding any. This should be done via info@gatorzoutlet.com

3.5.    If a product does not meet the quality requirements or is faulty by factory, the buyer has the right to demand a new product of the same kind.

3.6.    Should the product be defected, return fees should be covered by the Seller.

4.       Breaking the contract

4.1.    The buyer has the right to break the contract within 14 days after receiving the product.

4.2.    To break a contract, we kindly ask the buyer to notify of it via info@gatorzoutlet.com

4.3.    Notifying of backing from the contract should be done before the end of 14 days after the buyer has received the product.

4.4.    The buyer has to return the product in original packaging and no defects. When the product has been damaged, the Seller has the rights to reduce the refund amount.

5.       Results of backing from a contract

5.1.    If the buyer backs from a contract, all payments shall be returned by the Seller with the exception of delivery fees and any additional fee. This will be done within 14 days after receiving a notification about returning the product(s). Payments shall be made to the same account as they were made from. The Seller may refuse to refund the product before it has been returned.

5.2.    Delivery fees for returning the product should be covered by the buyer, tracking is optional.

5.3.    The buyer takes responsibility in returning the product in perfect shape with no faults.

5.4.    When replacing items from outside EU, the buyer shall pay the delivery to Gatorz and import charges.

6.       Force Majeure

Neither participant takes responsibility in Force Majeure events. Should any occur, the Seller will do it’s best to solve any issue as soon as possible.

7.       Warranty

7.1.  Please note that frames sold during SUPERSALE are final and are not covered by warranty.

7.2.  Warranty covers breakage and defects due to material and/or workmanship. Scratched lenses as a result of normal use are not covered by this warranty.

7.3.  All repairs will generally be completed within 3-5 working days and then returned via Postal Service. International shipping rates will apply.

7.4.  Gatorz Europe will not be held responsible for packages lost in transit.

7.5.  For warranty or replacement service: For a nominal fee, and on most of our products (not plastic), GATORZ Europe Ltd. offers a lens replacement and product repair / rebuild service. Contact GATORZ Customer Service office tel. +372-6030000 or email info@gatorzoutlet.com for details. Please visit www.gatorzoutlet.com to register your product and validate your warranty. Keep your receipt for proof of purchase. Warranty Service: Send your eyewear to address provided below using a shipping service that provides both insurance and tracking capability to ensure a safe delivery.

7.6.  Include within the package your eyewear receipt and a brief description of the problem or service requested, along with your name, return address, email (optional) and telephone number. Notify GATORZ EUROPE Ltd of an incoming package via info@gatorzoutlet.com. Include EUR 10.00 for return shipping and handling
